Respondent’s children took admission in petitioner school and paid Rs.1,10,000/- on 26.3.2008.  Respondent withdrew his children from the school on 29.5.2008 before the start of the academic year.  Respondent’s children did not attend the school even for a single day.  Respondent withdrew his children from the petitioner school primarily because the petitioner school did not have a Sanskrit teacher although Sanskrit was given as one of the optional languages.

          Fora below have directed the petitioner to refund the amount paid by the respondent.  We agree with the view taken by the fora below.  Respondent withdrew his children before the start of the academic year because the petitioner did not have Sanskrit teacher to teach the language.  No merit.  Dismissed.
