Sh. Ajay Shanker, Adv.appeared on behalf of the opposite parties No.2 & 3 and filed memo of appearance. None appeared on behalf of the opposite party No.1 despite due service, as such, opposite party No.2 is proceeded against ex-parte.

Sh. Ajay Shanker, Adv.counsel for the opposite party No.3 got recorded his statement that opposite party No.3 is ready to refund the price value of the mobile handset in question amounting to Rs.11000/- to the complainant subject to return of mobile set in question, original bill & job sheet and accessories to the opposite party within 15 days from today. In view of the above statement, Sh. Davinder Singh, Adv.counsel for the complainant got recorded his statement that in view of the statement made by the counsel for the opposite party No.3, he agreed with the same and the Hon'ble Forum may pass adequate order for the time period for compliance of the said statement.

In view of the statements of both the parties, present complaint is disposed of with directions to the complainant that he shall return the mobile set in question, original job sheet, original bill alongwith the accessories in possession of the complainant, to the opposite party within 15 days from today and opposite party No.3 is directed to refund the price value Rs.11000/- of the mobile set in question within one month from the date of receipt of the mobile set in question, original job sheet, original bill alongwith the accessories in possession of the complainant to the opposite party. File is ordered to be consigned to the record room.
