ORDER

 

       We are happy to note that during the pendency of these appeals, with the intervention of learned counsel, the parties have agreed to settle the dispute, subject matter of these appeals, out of court. It is agreed that in addition to the amount (s) already deposited and withdrawn by the Respondent/Complainant, a further sum of Rs.5 lakhs shall be paid by the Appellant in FA No.119 of 2008 as full and final settlement of the claim made by the Complainant, which shall form part of the corpus fund for a trust to be formed by the Complainant for the welfare of visually challenged children. 
The said amount shall be paid within two weeks from the date of communication by counsel for the Complainant to the Appellants, in the said appeal, about the formation of the trust and its name. It goes without saying that in view of the aforesaid amicable settlement, the complaint giving rise to the present appeals would not survive and as agreed, is dismissed.

          Both the first appeals stand disposed of in the above terms.
