Case called out repeatedly. Complainant is absent. Opposite party No.2 is present through Counsel. It appears from perusal of the record that, complainant was absent on earlier dates i.e. on 29/11/2017, 09/01/2018 and 01/02/2018. He has not filed his evidence to show that, he has purchased the alleged bottle of Bailley water from opposite party No.1. He has also not filed evidence to show that, after consumption of the alleged bottle, the complainant or his family members were fallen ill or in any way, the alleged water caused harm to them. In view of the above, there is no   justification for further proceedings in the present case. The case is dismissed. Both the parties shall bear their own costs. Let record be consigned.
