Despite repeated calls applicant / Decree Holder has not appeared. The present second application RA/84/2023 dated 02.11.2023 for restoration of original execution petition has been filed which was dismissed in default of the applicant / Decree Holder vide order dated 15.02.2023. The applicant / Decree Holder has also preferred earlier an application RA/34/2023 dated 26.04.2023 for restoration of original execution petition which was dismissed in default of the applicant / Decree Holder vide order dated 18.07.2023. Today also applicant / Decree Holder is absent to press the present second application for restoration of original execution petition. It appears that applicant / Decree Holder is not interested in pursuing present application. Therefore present second application is also dismissed in default of the applicant as well as for non prosecution.
