1. Ashish Kumar complainant has preferred the present complaint against the opposite parties (referred to as OPs in short) on the ground that he purchased 16 items from the OP vide invoice number 3570004137923 dated 21.03.2017 for an amount of Rs.901.85 out of which an item having UPC No. 8908000873612 namely Foodex Bhavnagr was charged for Rs.39/- rather the M.R.P. printed on the said item was Rs.30/- and as such the OP charged excess price of Rs.9/- . Thus, alleging unfair trade practice on the part of OP, the complainant has sought following reliefs:-
i) OP be directed to refund amount of Rs.9/-,
ii) OPs be directed to pay to the complainant a sum of Rs.25000/- as compensation on account of mental agony, harassment,
iii) OPs be directed to pay Rs.11000/- as litigation expenses.
2. Despite service, OPs did not appear and as such they are proceeded exparte.
3. In his exparte evidence, the complainant has tendered documents Ex.C-1 to Ex.C-3 and closed evidence.

From the perusal of documents placed on the file and after hearing the arguments of the learned counsel for the complainant, we find that the complainant purchased 16 items from the OP vide invoice number 3570004137923 dated 21.03.2017 for an amount of Rs.901.85 which is Ex.C-2 on record. The complainant grievance is that OP charged an amount of Rs.39/- for item having UPC No. 8908000873612 namely Foodex Bhavnagr whereas the M.R.P. printed on the said item was Rs.30/- and as such the OP charged excess price of Rs.9/-. We have perused the retail invoice/ receipt Ex.C-2 and product in question Ex.C-3 and found that the OP charged Rs.39/- for item having UPC No. 8908000873612 namely Foodex Bhavnagr whereas the M.R.P. printed on the said item was Rs.30/- and as such the OP really charged an excess amount of Rs.9/- from the complainant. The OP has not come forward to contest the case of the complainant rather they chosen to remain exparte. As such evidence produced by the complainant has gone rebutted on record.
5. For the reasons recorded above, we allow the complaint and direct the OP to refund an amount of Rs.9/- excess charged from the complainant. We direct the OP to pay to the complainant a consolidated amount of compensation of Rs.5000/- on account of mental pain, agony harassment and litigation expenses and also to deposit Rs.5000/- in the Consumer Legal Aid Account maintained with this Forum.
6. This order of ours shall be complied with within 30 days from the receipt of copy of the order. Copy of the order be supplied to the parties free of charge. File be consigned to records in due course. Announced
