Mr.Ankush Navghare-Advocate for the complainant is present.  Mr.Rajkumar Mhatre-Representative for Mr.S.R.Singh-Advocate for the opponent is present.  The opponent has submitted that the present complainant has already filed the consumer complaint No.CC/13/77 before the District Forum, Kolhapur and District Forum, Kolhapur allowed the complaint.  The present opponent filed appeal before the Hon’ble State Commission bearing First Appeal No.A/14/279 and the same is pending.  The complainant has filed this second complaint on the same ground therefore it is not maintainable.  As the complaint is already decided by the District Forum, Kolhapur, the present complaint is dismissed.
