By  Smt.Padmini Sudheesh, President :

          Heard on admission and rejected as barred by limitation.  The case is that the husband of complainant and father of other complainants Sri.Raveendran died on 4/2/11.  He has taken a policy from the respondents.  During the pendency of the policy the insured died on 4/2/11.  The 1st complainant has given original policy and other documents necessary for claiming death benefit to the agent.  But no amount paid and complainant approached the office of the insurance Ombudsman.  But no fruitful result was received and a lawyer notice dated 4/7/13 was sent.  This complaint is filed to get the policy amount and compensation.

 

          2. It is seen that the complaint is barred by limitation under Section 24(A)(1) of Consumer Protection Act.  The complainants produced copy of some documents and one document dated 18/8/11 would show that the respondents  had intimated first complainant  that her request cannot be acceded.  As per the document produced by complainants the cause of action arose from that day onwards.  It can be considered  repudiation of the claim of complainant.  No other document produced to show the repudiation of claim from respondents.  There is no averment in the complaint about the filing of claim, process of claim, repudiation of claim etc.  It is stated in the complaint that the cause of  action arose on 4/7/13 when the lawyer notice is sent.  This view of complainant is  utterly false and the cause of action will arise only from the repudiation of claim  and  in this case it is as 18/8/11.  So the complaint should be filed within  two years from 18/8/11.  The complaint is barred by limitation and is liable to be rejected.  Hence we do so.
