 The complaint as well as affidavit filed by the complainant was silent when he purchased the mobile and its costs. Ex.A1 and A2 receipts revealed that the complainant handed over his mobile for repairs to the opposite party on 14-09-2010 and paid Rs.495/- . The opposite party did not respond  to the notice issued by the complainant as seen from Ex. A-3 to A-5. The contents of the affidavit are deemed to have been proved as the opposite party remained ex-parte. The Opposite party not returning the mobile to the complainant after effecting repairs amounts to deficiency of service. Under those circumstances the complainant is entitled for return of Mobile from the opposite party. For the above discussion this point is answered in favour of the complainant.
