1.The case of the complainant is that the complainant has purchased some house hold materials from the O.P/ Future Retail Ltd., Big Bazar on dt.15.08.2019, amounting to total Rs.7,162/- ( Rupees seven thousand one hundred sixty two ) only and the complainant obtained valid bill from the counter. That the complainant had purchased product “Britannia milk Powder 1Kg” bill to Rs. 435/- (Rupees four hundred thirty five) only instead of Rs.370/- which is written on the said product. On dtd.15.08.2019 the O.P has given offer of Pay TM Cash back offer of Rs.300/- + Rs.300/- total Rs.600/- out of purchased price of Rs.3,000/- ( Rupees three thousand)) only which has not been credited to Pay TM. On dt.16.08.2019, the complainant has complaint the above matter to the O.P but they did not hear the request of complainant later tried to rub the said product, Being aggrieved, the complaint sought Redressal before this Commission.
2.The case of the Opposite party is that the O.P did not appear in this commission and did not file their version. Sufficient opportunity has been given to the O.P. to file their version. Hence the O.P is set ex-parte on dt.22.03.2023.

Perused the documents filed by the complainant and it reveals that the complainant had purchased “Britannia Milk Powder 1 Kg” on dt. 15.08.2019, the price in the bill was Rs.435/- that the actual price on packet was Rs.370/-. The O.P has committed unfair trade product by taking excess amount of Rs65/-for the above said product. The complainant has also complained regarding this matter the O.P, the O.P in spite of solving the case put a deaf ear to it. For unfair trade practice of the O.P the case lies in favour of the complainant. Accordingly it is ordered.
ORDER
The complaint is allowed ex-parte against the O.P. The Opposite Party is directed to refund the excess Rs.65/- at the rate of 12% P.A to the complainant. The O.P is also directed to pay Rs.1000/- (Rupees one thousand) only for mental harassment to the complainant. Failing which the entire order will carry 15% interest per annum till realization.
