By Smt. Padmini Sudheesh, President: Petitioners case is as follows: Petitioner is a minor and represented by his natural guardian father. There were three kuries in the name of minor petitioner in the respondent firm as per statement Nos.34, 52 and 53. In the kuri as per statement No.34, the petitioner had remitted a total sum of Rs.75,000/- and in other kuris a total sum of Rs.52,000/- also remitted. From 2006 January onwards the complainant couldnt remit the kuri amount due to stoppage of functioning of the firm. So the remitted amount is to be returned. Hence this complaint. 2. Respondent is declared exparte. 3. To prove the case, petitioner has filed affidavit and six documents, which are marked as Exts. P1 to P6. 4. There is no contrary evidence. 5. According to the petitioner, she is entitled to get back Rs.1,27,000/-. She also claimed 12% interest. As per the passbooks produced, it can be seen that the total amount due is Rs.1,26,590/-. So she is entitled for that amount only. 6. So the petition is allowed and the respondent is directed to return the amount of Rs.1,26,590/- (Rupees one lakh twenty six thousand five hundred and ninety only) to the petitioner with interest at the rate of 12% for each instalment till realisation. Respondent is further directed to pay Rs.500/- (Rupees five hundred only) towards costs to the petitioner. Comply the order within three months.
