There were two kuries in the name of minor petitioner in the respondent firm as per statement Nos.50 and 51. Petitioner had remitted a total sum of Rs.52,000/- in the kuries. From 2006 January onwards the complainant couldn’t remit the kuri amount due to stoppage of functioning of the firm. So the remitted amount is to be returned. Hence this complaint.<br /> <br /> 2. Respondent is set exparte.<br /> <br /> 3. To prove the case, petitioner has filed affidavit and five documents, which are marked as Exts. P1 to P5. <br /> <br /> 4. There is no evidence to the contrary.<br /> <br /> 5. According to the petitioner, he is entitled to get back Rs.52,000/-. He also claimed 12% interest. As per the passbooks the amount due is Rs.51,840/-. So the complainant is entitled for that amount only.<br /> 6. So the petition is allowed and the respondent is directed to return the amount of Rs.51,840/- (Rupees fifty one thousand eight hundred and forty only) with interest at the rate of 12% for each instalment till realisation and also to pay Rs.500/- (Rupees five hundred only) towards costs to the petitioner.
