By Smt. Padmini Sudheesh, President: Petitioner was a subscriber of respondent firm and joined in four kuries as per statement Nos.107, 108, 46 and 47. As per statement Nos.107 and 108 he had remitted a total sum of Rs.26,000/-and as per statement Nos.46 and 47 he had also remitted a total sum of Rs.52,000/-. From 2006 January onwards he couldnt remit the kuri amount due to stoppage of functioning of the firm. So the due amount to be returned. Hence this complaint. 2. Respondent is set exparte. 3. To prove the case, petitioner has filed affidavit and documents, which are marked as Exts. P1 to P7. 4. According to the petitioner, he is entitled to receive Rs.52,000/- as per statement Nos.46 and 47. But the pass books shown that the amount due is Rs.51,840/-. So he is entitled for that amount only. He also claimed 12% interest. As per Exts. P1 and P2 pass books the total amount due is seen Rs.51,840/-. So he is entitled for that amount only. There is no counter evidence. 5. So the petition is allowed and the respondent is directed to return an amount of Rs.77,840/- (Rupees seventy seven thousand eight hundred and forty only) with interest at the rate of 12% from 2006 January onwards till realisation and also to pay Rs.500/- (Rupees five hundred only) towards costs to the petitioner.
