By Smt. Padmini Sudheesh, President: <br /> <br /> Petitioner was a subscriber of respondent firm and had joined in two kuries as per statement Nos.48 and 49. She had remitted a total sum of Rs.52,000/- in the firm. From 2006 January onwards the complainant couldn’t remit the kuri amount due to stoppage of functioning of the firm. So she is entitled to get back the remitted amount and hence this complaint.<br /> 2. Respondent optioned to remain as exparte.<br /> <br /> 3. To prove the case, petitioner has filed affidavit and five documents, which are marked as Exts. P1 to P5. <br /> <br /> 4. There is no counter evidence. <br /> <br /> 5. According to the petitioner, she is entitled to get back Rs.52,000/- as total. She also claimed 12% interest. But as per Exts. P1 and P2 pass books the total amount due is seen Rs.51,840/-. So she is entitled for that amount only.<br /> 6. So the petition is allowed and the respondent is directed to return the amount shown in Ext. P1 and P2 pass books with interest at the rate of 12% for each instalment till realisation and also to pay Rs.500/- (Rupees five hundred only) as costs to the petitioner.
