The case of the complainant in short is that complainant purchased a SANSUI Colour Television (model no.CTVSCF29SDJ-CFA) on 1.3.09, now there is problem in the picture quality, as the picture has turned reddish and deteriorated the picture day by day. Complainant contacted with customer service of SANSUI in order to repair the television on 4.7.12, Ref. No.KOL 0407120202. A technician of Fresh Touch named Sri Netai Debnath has visited for repairing the television in complainant’s house, but he failed to repair and disturbed the picture colour quality to worst than before. He advised to the complainant the television set to bring his service centre in complainant’s own arrangement. After that complainant has contacted with customer service of SANSUI 15 times informing about his dissatisfaction and requested them to send an expertise technician to repair the television. Complainant sent an e-mail also to customer service of SANSUI on 21.9.12. Complainant was shocked to know that each time complainant was cancelled either by customer service or by the technician Sri Netai Debnath and also remarked complainant not to place any further complaint. Hence, the case was filed by the complainant with the prayers contained in the petition of complaint.
O.ps. did not contest the case by filing w/v and matter was heard ex parte against the o.ps.
Decision with reasons:
We have gone through the evidence and documents in particular and we find that the evidence adduced by complainant has not been rebutted and has remained as unchallenged testimony and we find no reason to disbelieve the evidence adduced by complainant.
In view of the above position, we are of the opinion that complainant has been able to substantiate and prove his case and is entitled to relief.
Hence, ordered,
That the case is allowed ex parte with cost against the o.ps. O.ps. are jointly and/or severally directed to refund a sum of Rs.9000/- (Rupees nine thousand) only towards the excess amount charged by o.ps. and are further directed to pay to the complainant a sum of Rs.10,000/- (Rupees ten thousand) only as compensation for harassment and mental agony and litigation cost of Rs.400/- (Rupees four hundred) only within 45 days from the date of communication of this order, i.d. an interest @ 10% p.a. shall accrue over the entire sum due to the credit of the complainant till full realization.
Supply certified copy of this order to the parties free of cost.
