ORDER

JUSTICE SRI.K.R.UDAYABHANU    : PRESIDENT

The appellants are the opposite parties/Coastal Urban Co-Operative Bank Limited, Kottamukku who are under orders to renew the Ext.D1 fixed Deposit and to pay Rs.5000/- towards compensation and Rs.1000/- towards cost in OP.90/05 in the file of CDRF, Kollam.
          2. The only dispute in the matter is with respect to the renewal of fixed deposit receipt for sum of Rs.75000/- as requested by the complainant. The opposite parties refused to renew the above fixed deposit on the ground that another faction of the Association has issued notice directing to remit interest on the F.D in the SB account of the Association being operated by the present office bearers. It is the contention of the opposite parties/appellant that it was on account of the above dispute between present office bearers of the Latin Catholic Association and the complainant that the fixed deposit was not renewed. We find that there is no justification for the attitude of the appellants in not renewing fixed deposit as requested by the complainant who had made initial deposit in the name of the Association. We find that there is no risk factor involved in the matter so far as the appellant is concerned. In the above circumstance the Forum directed the renewal and to pay compensation of Rs.5000/- etc. We find that the Forum is not at all in error in considering the matter. There is no scope for interference. In the result the appeal is dismissed in limine.
