This order shall dispose off an application filed by the Complainant for restoration of his complaint which was dismissed on 28.03.2022.

The brief facts necessary for the disposal of this application are that the Complainant has filed a complaint under section 35 of the CPA 2019. This complaint was dismissed for Non-prosecution vide order dated 28.03.2022.

We have heard the Learned Counsel for the Complainant/applicant and have perused the file the case of the applicant is that the Non-appearance of the Complainant was not intentional.

The perusal of the file shows that complaint was filed on 08.11.2021 an thereafter the file was taken up for Nine consecutive dates. The Complainant did not appear even a single time on the said Nine dates and ultimately the complaint was dismissed on 28.03.2022. No reason has been assigned in the application for Non-appearance of the Complainant or his counsel for the Nine dates. Even the application is not supported by any affidavit. It is also important to note that the application is not even signed by the Complainant. Therefore, under these circumstances, we do not see any merit in the application. The complaint is dismissed accordingly.  

 

                Copy of this order be given to the Complainant/applicant free of cost.
