No stay order or any other order has been received from the Hon'ble National Consumer Disputes Redressal Commission, New Delhi or any other Court.

2.                           This application has been filed by the applicant/respondent No.1/complainant  for release of Rs.30,000/-, alongwith interest, if any,  accrued thereon, deposited by the appellants/Opposite Parties No.1 to 3, at the time of filing the appeal.

3.                           The perusal of the record shows that against the order dated 28..02.2013 passed by the District Consumer Disputes Redressal Forum-II, UT, Chandigarh, an appeal was filed by the appellants/Opposite Parties No.1 to 3, which was dismissed vide order dated 16.04.2013. Thereafter, the applicant/respondent No.1/complainant filed Misc. Application No.103/2013 in C.C.No.203/2012, wherein, an order dated 24.09.2013 was passed by the District Forum. It  is evident from copy of the order dated 24.09.2013 placed, on record, that Sh.Santokh Singh, Counsel  for OP No.1 to 3, alongwith Mrs.Amarjit Sra, Manager (G) of Food Corporation of India, OP No.2 made the statement as under:

 

“The OP No.1 to 3 had deposited a sum of Rs.30,000/- with the Hon’ble State Commission, UT, Chandigarh, on 02.04.2013, at the time of filing the appeal. The OP No.1 to 3 have no objection if the complainant withdraws this amount from the Hon’ble State Commission, UT, Chandigarh

 

4.                           It is further evident from the order dated 24.09.2013 that Sh.Satpal, applicant/respondent No.1/complainant after going through the statement, referred to above, agreed that he would approach this Commission for release of Rs.3,0000/- deposited by appellants/Opposite Parties No.1 to 3 at the time of filing the appeal.  The miscellaneous application, referred to above, was accordingly disposed of and the parties were directed to remain bound by the statements made before the District Forum.       

5.                           In view of the above, there is no legal impediment, in allowing the application, in the manner, that a sum of Rs.30,000/-, deposited by the appellants/Opposite Parties No.1 to 3, at the time of filing the appeal,  alongwith interest, if any, accrued thereon, shall stand refunded, in favour of the applicant/respondent No.1/complainant , against valid receipt and on proper identification.

6.                           The application stands disposed of accordingly.

7.                           Necessary intimation, in this regard, shall be sent to the District Forum, concerned.

8.                           Certified copy of the order be sent to the parties free of charge.
