Ram Parkash Vs. FCI

 

Present:        Complainant in person with Sh. Neeraj Rajoria, Adv.

                     Sh. Sant Anand Kumar Rana, AGM, FCI, Regional Office, Haryana, Panchkula for respondents.

 

                   Complainant suffered separate statement according to which pivot of the complaint is revolving around sale deed No. 4221 dated 10.01.1994 (for short sale deed) which was executed in favour of the complainant and complainant while borrowing loan from the respondent pledged the same with the respondents. He paid the amount to the respondent, but his sale deed which was pledged with the respondents was not returned to him, which made him aggrieved, necessitating him to file the complaint before this Forum. The respondent in their written statement admitted the pledging of the sale deed with them. However, in para No. 5 of the written statement, they candidly pleaded the original loan file of the complainant including the sale deed was weeded out and the same was communicated to him. Once the respondents have taken stand the loan file including the sale deed was weeded out then it is not impossible to return the original by them to the complainant.

                   Keeping in view even date statements suffered by the complainant and observation made wherein before this Forum, the present complaint is dismissed as withdrawn, with the direction to the respondents to issue certificate in favour of the complainant within the period of 45 days from today certifying that the sale deed No. 4221 dated 10.01.1994 was weeded out in the process of weeding the office record, and complainant shall be at liberty to approach the appropriate Forum including Civil Court, if advised so, if he still have any grievance against the respondents. File be consigned to the records.
