Shri Santosh Kumar Ojha, Member : -The brief facts of the complainant’s case is that, the complainant dispatched some medicines and a Traction Machine through O.P to Darjeeling on dtd.31.05.2017 but till date the said articles/consignment are not delivered to the addressee, hence this case.
The O.P failed to appear after receiving notice and stand ex-parte ultimately.
Heard from the complainant and perused the case record alongwith materials available. The complainant booked a traction machine alongwith some medicines costing Rs.18,181.67P in total having Courier Consignment Note No.215258677 dtd.31.05.2017 through the O.P(Fly King Courier Service). The O.P has charged Rs.900/- only for the said courier service but till date the said consignment has not been delivered in the address provided. After repeated requests also the O.P did not turn up. The O.P kept silent in this case which reveals that he has nothing to say in this case.

Non delivery of the consignment after taking proper charges is nothing but is clear commitment of deficiency in service on the part of Courier Company which exactly happened in the present case. The O.P has not delivered the consignment in question to the addressee till date after taking proper courier charges from the complainant. Hence, we are in considered opinion to allow the complaint case with following directions to the O.P.
ORDER
The O.P is hereby directed to return the consignment bearing Courier Consignment Note No.215258677 dtd.31.05.2017 to the complainant or pay Rs. 18,182/- (Rupees eighteen thousand one hundred eighty-two) only towards cost of consignment and pay a sum of 10,000/- (Rupees ten thousand) only to the complainant towards mental agony, harassment including cost of litigation within 30 (thirty) days from the date of receipt of this order , failing which the O.P shall be liable for interest @10% per annum on the abovementioned awarded amounts till its realization.
Accordingly the case is disposed of.
Order pronounced in the open court today the 06th day of March’ 2018. Free copy of this order shall be supplied to the parties as per rule.
