                   Heard. The complainant has alleged that he placed an order for purchase of Electrolux Automatic washing machine of the value of Rs.15,990/- to the opposite party through on-line and made the payment of said amount on various occasions in installments. However, before the order could be honoured, the complainant cancelled the same and communicated this fact to the op through on-line. But the aforesaid amount of Rs.15,990/- has not been refunded to the complainant and instead thereof, a sum of Rs.4030/- has been debited by op from his account.  Since the order of washing machine was cancelled before receiving the same, we are of the considered view that complainant has not become consumer of the op and he has not availed any service of the op. So the complaint before this Forum is not maintainable.  Further, admittedly, Op has no branch office or its office to carry its business within the territorial jurisdiction of this Forum. As such, the present complaint is hereby dismissed being not maintainable before this Forum.  However, the complainant may seek other remedy for recovery of his amount before appropriate authority. File be consigned to the record room.
