The complaint was filed by the complainant under section 35 of the Consumer Protection Act 2019 alleging deficiency in service in selling a defective product along with a prayer to direct the opposite parties to pay Rs.14,499/- towards product cost and to pay a sum of Rs.50,000/- towards compensation for the mental agony and hardship caused to the complainant along with a cost of the proceedings to the complainant.
No representation for complainant. Proof affidavit not filed by the complainant. Sufficient opportunities given for filing Proof affidavit and for appearance on 29.09.2022, 20.10.2022, 08.11.2022, 22.11.2022 and on 29.11.2022. In spite of the same, complainant failed to appear and prosecute the case. Hence, this commission is of the view that no purpose in keeping the complaint on file. Hence the consumer complaint is dismissed for non prosecution. No cost.
