MISS SMITA RAY , L A D Y M E M B E R .
The petitioner has filed the present dispute alleging deficiency in service on the part of O.Ps.
The facts shortly are that the petitioner booked a bus ticket from Flipkart via make my Trip on 4thMarch-2019 and the transaction was not successful and an amount of Rs.2,700/- from the account of the petitioner twice of Rs.1350/- each was deducted bearing transaction No.IGAFOAMBU6 and IGAFOAUEM6 from the S.B A/C No.30735059387 . But the O.Ps are not taking any steps against the grievance of the petitioner . According to complainant it is a case of cheating for which the petitioner has filed the presen dispute with the prayer to direct the O.ps to return Rs.2700/- along with Rs.10,000/- as compensation.
After appearance the O.Ps filed their written version separately about each other’s regarding receipt of money . Further the O.Ps have stated in the written version vide para-10 the O.P.no.2 has stated that the petitioner has not supplied the detail information to find out the grievance of the petitioner , for which the dispute is liable to be dismissed.
After perusal of the record it is observed that vide para-2 of the complaint petition the petitioner has stated that he has been cheated by O.P.no.1 and 2. Hence, we hold it is not maintainable in this commission in view of the observation of Hon’ble National Commission reported in 1996(2)-CLT-252-N.C,( satish Behera Vrs. Canara Bank)
In the result the dispute is dismissed with the direction that the petitioner is at liberty to approach the proper forum for his grievance . No cost.
This order is pronounced in the open commission on this the 20th day of November,2019. under my hand and seal of the Forum.
