Final Order / Judgement

Today is fixed for showing cause by the complainant.

The Ld. Advocate of the OP is present. But none appears on behalf of the complainant and no show cause is filed. It was clarified on the previous day that the suit would be dismissed in case of the default on the part of the complainant in the matter of showing cause. Such being the position we see that the complainant is no more interested to proceed with the case and therefore, the case should be dismissed with default.

Hence it is ordered that the case be and the same is dismissed with default, but without any cost.

Let a plain copy be given to the parties free of cost as per CPR.
