CONSUMER COMPLAINT NO.763  OF  2022

ORDER

1.   Heard. At this stage, the matter has been settled between the parties. Vide his separate statement, Sh.Atul Goyal, Counsel for OP No.2 has stated that the matter has been settled between the parties and as per settlement, the OP No.2 shall pay a lumpsum amount of Rs.15,000/- to the complainant within a period of 30 days from today(10.01.2024) in full and final settlement of the present matter, failing which the OP No.2 shall be liable to pay the aforesaid amount alongwith interest @ 9% p.a. from the date of filing of present consumer complaint. Vide his separate statement, Sh.Devinder Kumar, Counsel for Complainant has admitted the aforesaid statement of Sh.Atul Goyal, Advocate for OP No.2 and prayed that the complaint be disposed of in terms of aforesaid settlement. Counsel for complainant has undertaken to supply the copy of cancelled cheque of the complainant to the counsel for OP No.2 within 7 days from today. It has been further stated by counsel for complainant that he does not press any claim against remaining OP No.1 & 3.

2.   In view of the statements made by the counsel for OP No.2 as well as counsel for complainant and in terms of the settlement, the complaint stands disposed of by passing the following order:-

1. OP No.2 shall pay a lumpsum amount of Rs.15,000/- to the complainant within a period of 30 days from today(10.01.2024).
2. In case OP No.2 fails to pay the aforesaid amount within the stipulated period, then OP No.2 shall be liable to pay the same alongwith interest @ 9% p.a. from the date of filing of present consumer complaint i.e. 26.08.2022 till the payment is made.

3.   The complaint against OP No.1 & 3 stands dismissed being not pressed by the complainant.

4.   Certified copies of this order be sent to the parties free of cost. The file be consigned.
