Final Order / Judgement

Today the instant case is fixed for hearing on the point of admissibility.

 

            Complainant is found absent despite of repeated calls.

            It appears from the c/r that the instant case was filed on 06/04/2024 and admission hearing was fixed on 23/04/2024. Further it is seen from the c/r that on 23/04/2024 the complainant remain absent.

Further a date was given by this Commission for admission hearing fixing 24/04/2024 but on 24/04/2024 complainant was remain absent as this Commission further extended time considering ends of justice by fixing today for admission hearing.

            Despite giving repeated chances for admission hearing, the complainant did not appear and admission could not be done due to absence of the complainant. The statutory period of 21 days for admission hearing as provided in the C.P. Act, 2019 has already been expired.

            Therefore, we don’t have any option but to dismiss the case.

            Accordingly, the consumer complaint, being consumer case No. 13/2024 is dismissed for default, without being admitted.

Final Order

An application has been filed by the complainant under section 35 of the C.P. Act, 2019, alleging deficiency in service against the O.P.

The consumer complaint was filed on 06/04/2024 but since after filing the complainant did not turn up before this Commission for admission hearing.

Therefore the case has been dismissed for default by an order being Order No.  4 dated – 09/05/2024.

Let the said order be considered as part of this final order.

Accordingly the consumer complaints being cc No. 13/2024 is dismissed for default without being admitted.

Let a free copy of this order be given to the parties concern as per C.P. Rules and Regulations, 2020.
