O R D E R
1.This petition has been filed U/S 35 of the Consumer Protection Act, 2019 by the complainant Sri Mrinal Debnath of Bhati Abhoynagar, Agartala & Others against the O.P. Flipkart Internet Private Ltd., Bengaluru, Karnataka and indigo, Gurgaon, Haryana alleging deficiency in service on the part of the O.Ps.
2.However, on the prayer of the Complainant the names of other Complainant except Sri Mrinal Debnath and also the name of Indigo, i.e. the O.P. No.2 were deleted vide order dated 10/08/2022.
3.The case of the complainant in brief is that on 14/08/2021, the Complainant booked three(03) Air Tickets from Indigo through Flipkart Travels Sector for travelling from Agartala to Kolkata for Rs.6,010/-. After booking, Complainant cancelled the same tickets with due consultation with Indigo authority and Indigo has assured to refund the amount Rs.5,442/-.
4.It is stated by the complainant that the Indigo has refunded Rs.5442/- to Flipkart Travels after deduction of an amount of Rs.568/-. Accordingly, the Complainant approached to the Flipkart Travels to transfer the said amount in his account. But Flipkart Travels opposed to transfer the amount to the Complainant that as per provision no amount is refundable.
5.Thereafter, Complainant made several communications with the Flipkart for refund of the amount but Flipkart refused on flimsy ground. He also forwarded the e-mail received from Indigo regarding the refund of amount to Flipkart Travels on 12/09/2021, 14/09/2021, 16/09/2021 & 26/09/2021. But still Flipkart did not refund the said amount to the complainant.
6.Hence, the complainant filed this petition before this Commission claiming compensation of Rs.2,50,000/- for mental agony, harassment due to deficiency in service etc. and also Rs.10,000/- as litigation cost.
7.Since the O.P. Flipkart failed to submit written version although several chances were given, the case has been proceeding ex-parte against O.P. vide order dated 06/12/2022.
8.The Complainant filed evidence on affidavit reiterating the facts as contented in his complaint petition.
9.The complainant argued his case mainly on the ground of harassment because ultimately O.P. Flipkart on 05.05.2022 deposited Rs.6010/- in the Bank Account of the complainant. The complainant on 13.03.2023 deposited a copy statement of his Bank Account as he was directed by this Commission vide order dated 24.02.2023.
POINT TO BE DETERMINED:-
10.On the basis of the pleadings following point emerged for discussion and decision:-
(I) Whether there is any deficiency of service on the part of the O.P and the complainant is entitled to get compensation as prayed for?
DECISION AND REASONS FOR DECISION:-
11.Admittedly, although Indigo refunded the amount to the account of Flipkart, the Flipkart Authority delayed such payment although claimed by the complainant. However, Flipkart deposited this amount on 05.02.2022 which the complainant divulged on 24.02.2023. Therefore, at least from 05.05.2022 till today the complainant can not claim any deficiency and consequent compensation from O.P. Flipkart. Hence, considering the entirety of the case, we order the O.P. No.1, Flipkart Internet Pvt. Ltd. to pay a compensation including litigation cost to the complainant for a sum of Rs.10,000/-(Rupees Ten Thousand). This amount shall bear interest @ 7.5% P.A. from today till the date of actual payment, if not paid within 30(thirty) days from today.
The case stands disposed off.
Supply a copy of this Final Order free of cost to the complainant and the Opposite party.
