The complainant Namita Nayak has filed this case U/S 35 of the CP Act 2019, alleging deficiency in service on the part of the Fino Payment Bank for freezing her bank account praying theirin for direction to the O.P to activate her account.
- Brief fact leading to the case is that the petitioner is having one account in Fino Payment Bank bearing customer ID 024252589. She was transacting in online banking through her registered Mobile No.7978872909. The husband of the complainant credited a sum of Rs.10,000/-(ten thousand) only to without any notice her account was deactivated by the O.P. without her account on 15th September 2022. In spite of repeated approaches the O.P did not activate her account for which she has filed this complain before this Commission for a direction to the O.P for activating her account.
- After receipt of complaint through the e-filing system notice was issued online to the O.P. Even though service of notice was sufficient and the O.P he preferred not to appear nor challenge the allegation raised against him. So this Commission proceeded to dispose off the case on the basis of the documents available of record.
- The complainant in support of her case has filed the copy of the statement of accounts relating to her and the copy of the statement of accounts relating to her husband. It is seen from the statement of accounts of her husband Aswini Kumar Singh that a sum of Rs.10,000/- has been transferred to from his account the account of complainant on 15th Sept.2022. From the statement of accounts of Fino Payments Bank. It is seen that a sum of Rs,10,000/- has been credited to her account. The sole allegation of the complainant is that her account has been blocked after the money is credited to her a/c. As the O.P did not appear nor cited any reason regarding the blocked account we are of the opinion that the action of the O.P Bank is completely illegal and its amounts to deficiency in service and hence the order
ORDER
The complaint petition is allowed to ex-parties against the O.P. The O.P is directed to immediately activate the account of the complainant bearing customer ID02425258929(Mobile-7978872909)forthwith on receipt of the order failing which the O.P shall pay compensation of Rs.1000/- daily to the complainant, so long as the order is not complied. The O.P.is further directed to pay compensation of Rs.20,000/- for deficiency in service and harassment and sum of Rs.5,000/- towards cost of litigation. The order as to cost and compensation shall be paid with in a period of 30 days from the date of receipt of this order.
