ORDER

 

Perusal of the record shows that on Counsel for the Complainant lastly appeared on 13.02.2019 thereafter proxy counsel for the complainant took adjournment on 24.05.2019 as well as 27.11.2019. Thereafter, Complainant stopped appearing before this Commission. In fact Court Notice was also issued to the Complainant on 12.11.2021.

 

Counsel for OP states that Complainant has already attended the Class for more than 1 year and thereafter he filed the case. In view of the NCDRC Judgment tiltled as M/S FIITJEE LTD VS PRAMOD PAREEK decided on 10.07.2020 vide revision petition No. 462 of 2013 wherein NCDRC states that if the student withdrawing in the mid-way will not be entitled to seek any refund.

It seems that Complainant is not interesting in pursuing the matter. Hence, the case is dismissed in view of the Judgment of the NCDRC Judgment and for non-appearance and non-prosecution.
