O R D E R

            The case of the complainant presented on 9..4..2010 is as follows:
He had entrusted the Medical Certificate, copy of passport photo with the opposite party for sending his friend for arranging vis a to his son. He had remitted Rs. 1815/- to the 1st opposite party for sending the items to the addressee. At the time of accepting the charges from the complainant the opposite party had assured that the items to be reached at the addressee  within 3 days. But the item did not received the addressee till date. Thereafter the complainant sent another items to the addressee by speed post. There was deficiency in service on the part of the opposite parties. The complainant had sustained less and damages. Hence this complaint.
            The notices were served with the opposite parties. They did not appear either in person or through their caused even after accepting the notice from this forum. Hence the opposite parties set exparte.

            The complainant filed proof affidavit and documents with are marked as exhibits A1 and A2.
            We have gone through the complaint documents and evidence. The case of the complainant is that the opposite party has not send the received items from him to the addressee at UAE. According to him after receiving the sending charges Rs. 1815 the opposite parties assured that within  3 days the items should be reached a t the addressee. 
But after several enquiries made by the complainant items did not reached at the addressee. The case of the complainant stands un-challenged by the opposite parties even after given sufficient opportunities. There was deficiency in service on the part of the opposite parties. We have o reasons to dis-believe the case of the complainant. We are of the opinion that the case of the complainant is to be allowed.
            In the result the complaint is allowed as follows:
            We direct the opposite parties to refund Rs. 1815/- (As per A1) to the complainant and pay Rs. 1000/- as compensation for inconvenience and pay Rs. 750 as cost of these proceedings. The order shall be complied with within a period of one month from the date of receipt of a copy of this order. The both opposite parties are jointly and severally liable to compensate the complainant. The opposite parties are not complied the order within one month the amount will carry interest @ 10% per annum from the date of filing this complaint ie. 9..4..2010 till payment.
