1.       None for the appellants is present their counsel Shri.Anilkumar B.Dhongade is also absent. Respondent No. 1 Shri.Farooq Khan Jabbar Khan Pathan as well as his counsel Shri. S.V.Warad is also absent. None for the respondent No. 2 is present. On 25/04/2013 notice was issued to appellants as well as respondents and their respective counsel, but no report about service of notice is received. However, the office copy of the notice reflects that it was issued on correct address of both the parties as well as their respective counsel  as shown in the appeal memo. Therefore, it will have to be presumed that they are served with notice, but nobody is turned up. Therefore there is no alternative except to dismiss the appeal for default. On last date also nobody for the appellants was present, however, the matter was adjourned till today by way of last chance. But today also nobody for the appellants as well as respondents is present. Hence, the appeal is dismissed in default. No order as to cost.
