ORDER:

Sukhpal Singh Gill, President

1.             Jaspal Singh complainant has preferred the present complaint against the opposite parties (referred to as OPs in short) on the ground that he got a finance of Rs.46600/- from the OP no.2 for purchase of Honda Motorcycle Dream Neo on 31.03.2014  and same amount was payable in 25 monthly installments of 2450/- each.  Due to some financial problem the complainant could not pay the full amount of last 3-4 installments and he arranged an amount of Rs.7500/- and that amount was paid to Harpal Singh Collector of OP no.2 but said Harpal Singh did not issue receipt. The complainant came to know from account statement that amount of Rs.7500/- was not credited in his account. Thereafter the complainant requested the OPs so many times to adjust the amount of Rs.7500/- but nobody paid any heed to the request of the complainant.  Thus, alleging deficiency in service on the part of OPs, the complainant has sought following reliefs:-

i)      OPs be directed to adjust  an amount of Rs.7500/-  which was duly paid to Harpal Singh,

ii)     OPs be directed to pay to the complainant a sum of Rs.50000/- as compensation   on account of mental agony, harassment,

iii)  OPs be directed to pay Rs.11000/- as litigation expenses.

2.             Despite service, OPs did not appear  and as such they are proceeded exparte.

3.             In his exparte evidence, the complainant has tendered documents Ex.C-1 to Ex.C-9 and thereafter remaining evidence of the complainant was closed by order of the Forum as complainant failed to produce remaining evidence after taking so many opportunities.

4.             From the perusal of documents placed on the file and after hearing the arguments of the learned counsel for the complainant, we find that the complainant got finance of Rs.46600/- from the OP no.2 for purchase of Honda Motorcycle Dream Neo on 31.03.2014. The said amount was payable in 25 monthly installments of Rs.2450/- each. The complainant has alleged that due to some financial problem he could not pay the full amount of last 3-4 installments and thereafter he arranged Rs.7500/- .  The said amount of  Rs.7500/- was paid to Harpal Singh, collector of OP no.2  but Harpal singh did not issue any receipt on the pretext that receipt book was not available. The complainant's case is that he came to know that the amount of Rs.7500/- was not credited in his account. The complainant has not produced on record any document which could show that he paid Rs.7500/- to Harpal Singh Collector of the OP.  Surprisingly, the complainant has not produced his own affidavit to substantiate his case regarding payment of Rs.7500/- to Harpal Singh. Hence, in the absence of any documentary evidence it cannot be said that the complainant has paid an amount of Rs.7500/- to Harpal Singh, Collector of the OP.

5.             For the reasons recorded above, we find no merit in the case of the complainant and as such the complaint is dismissed. Copy of the order be supplied to the parties free of charge. File be consigned to records in due course.                                                                        Announced
