Counsel for the parties agree that the impugned order be set aside and the case remitted back to the State Commission for a fresh decision in accordance with law.  Ordered accordingly.

          Parties, through their counsel, are directed to appear before the State Commission on 7.2.2011.  Since it is an old case, the State Commission is requested to dispose of the matter expeditiously and preferably within a period of 4 months from the date of first appearance.

          Under an interim order of this Commission, petitioner DDA had deposited Rs.1 lakh before this Commission, which has been paid to the respondent/complainant.  Payment made to the respondent/complainant shall be subject to the decision rendered by the State Commission.
