ORDER

               

            This is a complaint under Section 35 of the Consumer Protection Act, 1986 moved by the complainant Dr. Vidusha    against  EZI Marriage Bureau-the opposite party.

 

2.             The brief facts of the complaint are that the OP  provides  the services of marriage bureau and gets the bachelors meet with their matches. In the last week of July 2021, the OP contacted the complainant and offered to provide her marriage profile for marriage and  allured the complainant by giving many offers.  On the various calls on the part of the OP, the complainant contacted the OOP telephonically  and paid Rs.6000/-  on 21.8.2021 through YONO SBI App in their  account in HDFC Branch at Kharar (Punjab)  and the OP assured the complainant to provide her so many profiles within couple of  days and demanded Rs.12,000/- and asked the complainant to deposit 50%  fee i.e. Rs.6,000/- as registration fee and rest amount will be deposited after getting suitable match.  After passing sufficient time, when the OP did not give any response then the complainant contacted the OP telephonically but again postponed the matter on one pretext or the other. It is further submitted that Ms. Muskan one of the employee of the OP before getting the  registration fee were talking with the complainant nicely but just after getting the registration fee, she started misbehaving  with the complainant and ultimately the complainant did not get any call from the OP and when the complainant tried to call the OP, their numbers have been getting switched off and they are not  responding to the complainant which amounts to deficiency in services on the part of the OP. Thus, the complainant has filed the present complaint alleging deficiency in services on the part of the OP and prayed that the OP be directed to refund the sum of Rs.6000/- to the complainant alongwith compensation for the mental harassment caused to her.

 

3.             Notice of the complaint was given to the OP but the OP failed to appear and contest the case despite due service. Therefore, OP was proceeded against ex parte vide order dated  22.11.2021.

 

4.             The complainant in support of her case has filed her affidavit Ex.CW1/A and  tendered documents Ex.C-1 to Ex.C-3 and closed her evidence.

 

5.             We have heard the learned counsel for the complainant and gone through the case file very carefully.

 

6.             The complainant has argued that OP  provides  the services of marriage bureau and gets the bachelors meet with their matches. In the last week of July 2021, the OP contacted the complainant and offered to provide her marriage profile for marriage and  allured the complainant by giving many offers.  On the various calls on the part of the OP, the complainant contacted the OOP telephonically  and paid Rs.6000/-  on 21.8.2021 through YONO SBI App in their  account in HDFC Branch at Kharar (Punjab)  and the OP assured the complainant to provide her so many profiles within couple of  days and demanded Rs.12,000/- and asked the complainant to deposit 50%  fee i.e. Rs.6,000/- as registration fee and rest amount will be deposited after getting suitable match.  After passing sufficient time, when the OP did not give any response then the complainant contacted the OP telephonically but again postponed the matter on one pretext or the other which amounts to deficiency in services on the part of the OP.

 

7.             From the above version put forwarded by the complainant it is established that the complainant paid Rs.6000/- to the OP and the OP assured to provide suitable profile for her marriage but the OP failed to do so despite repeated requests. The above version of the complainant completely goes unrebutted and unchallenged because the OP failed to appear and contest the case despite due service and as such it is proved that the OP  failed to provide suitable profile for marriage of the complainant despite getting the sum of Rs.6000/- from the complainant. Therefore, deficiency in services on the part of the OP is established and the complainant is entitled to relief.

 

8.             In view of our above discussion and findings, we accept the present complaint and direct the OP to refund the sum of Rs.6000/- to the complainant alongwith interest @ 6% per annum from the date of filing of the present complaint i.e. 16.09.2021 till its actual realization. The complainant shall also be entitled to a compensation of Rs.10,000/- for the mental harassment and agony caused to her.  The OP is further directed to make the compliance of this order within a period of thirty days from the date of this order, failing which the complainant shall be at liberty to initiate proceedings u/s 71 of the Consumer Protection Act. Certified copy of this order be supplied to the parties concerned and the file be consigned to the record room after due compliance.
