Present :-          A/R for complainant.

                   During course of admission hearing A/R for complainant was confronted with the issue whether the consideration is paid by him to the OP. He showed hand written note and asserted that Rs. 10,000/- cash was given. However  on perusal of the hand written note it reveals that there is  over writing over the name of complainant and there is no stamp on the written note of OP to suggest that OP is an educational institution.  The A/R of complainant prima-facie is unable to show that there is any connection or contact between complainant and OP thus no question of deficiency in service against the OP arises.  As there is no cogent document which can be corroborated that the advance amount as alleged by the complainant was paid to the OP, so complainant cannot be said to be a consumer.

                        In light of above discussion and observations we are of considered view that prima-facie there is no cause of action against the OPs. Hence the complaint is not maintainable. Resultantly dismissed. File be consigned to record room.
