ORDER

CC No.339 of 2021.

Babita     Vs.   Exide LIC.

                        Ms. Rakhi Verma, Adv. for the opponent No.1.

                        Opponent No.2 ex-parte. 

                    

                 Settlement report dated 19.10.2023 from the Coordinator, Mediation Cell of this Commission received. The parties have arrived at settlement, which has been reduced into writing and signed by the counsel for the complainant as well as counsel for the opponent No.1. Ex.S1 is marked on the settlement.  In view of the settlement Ex.S1 between the parties, the complaint is, partly, accepted against the opponent No.1, holding the opponent No.1 is liable to pay Rs.6100/- (Rupees Six Thousand One Hundred only) as full and final claim against policy No.04011429 within the period of one month from the date of settlement i.e. on or before 19.11.2023, in default of it, the opponent No.1 shall be liable to pay simple interest @8% per annum on the claim amount of Rs.6100/- from the date of order till actual payment and it is further made clear, in case, the timely compliance of the order is not done by the opponent No.1 and the complainant is constrained to file an execution petition before this Commission to enforce this order, then, the opponent No.1 may be liable to make the payment of cost of execution proceeding to the complainant, which shall be assessed by the Commission at an appropriate stage.  In view of the settlement between the complainant and the opponent No.1, complaint qua opponent No.2 is dismissed. File be consigned to the records.
