JUDGEMENT

Mr. Purna Chandra Mishra, President.

          Complainant Biswanath Sahu has filed this case U/s 35 of CP Act-2019 alleging the deficiency of service on the part of the Opposite Party for not considering his case for invalid pension and praying therein for direction to the Opposite Party to consider his case for grant of invalid pension.

1. Brief fact leading to the case is that complainant suffered from cancer and was treated at Hemlata Hospital. During the course of treatment, there was surgery and there was a lot of money spent. After surgery, his legs are not functioning properly and he is unable to walk. Therefore, he prayed invalid pension to Executive Officer, NAC, Baliguda. But, he did not listen to his grievance for which he has filed this case before this Commission for the reliefs as discussed above.
2. After receipt of notice, the Opposite Party appeared through his authorized agent and filed written statement. In his written statement, the Opposite Party stated that the complainant’s case was referred to the Medical Board. But the Medical Board rejected his application and did not find to be disabled. So, the application for invalid pension was rejected.
3. We have gone through the records filed by the Opposite Party. It is seen from the intimation of the rejection of application for disability certificate by the Medical Authority Member on 19.04.2023 that No Disability has been detected in Biswanath Sahu. Since the Medical Board did not find him to be medically disable, the Opposite Party has rightly rejected his application and hence the order.

The complaint petition is dismissed on contest. Parties to bear their own cost.
