Final Order / Judgement

MR. PRAVAT KUMAR PADHI, PRESIDENT:-

          This C.C.Case No. 24/2023 has been filed U/s-35 of C.P.Act, 2019 seeking compensation of  Rs. 50,000/- for causing mental torture for issuing wrong bill of Rs. 78594/- instead of average previous reading as usually energy consumed by complainant & please to revise the excess bill on average.

            Complainant is absent after admission of the C.C.Case. We have gone through the C.C. & written version  filed by the Ops and found only 2 bills submitted by Complainant amounting Rs. 78,594.87/- in Dec-2022 as arrear & Rs. 78,395.41 as arrear in Jan-2023 and no previous bill showing arrear to be less or zero or any other amount.

            Ops have filed their written version stating there in that the original connection was given to Nrusingh Charan Behera and Complainant is the successor and there is huge outstanding. Complainant has never prayed for charge of old meter and installation of new meter or change the name of beneficiary and energy bills are calculated in actual consumption basis and not on average basis and there is huge outstanding against consumer is Rs. 78,651/- till May-2023.

            There is no material before us to come to conclusion that all of a sudden the bill has been issued amounting Rs. 78,394/395 or Rs. 78,594/595 as the case may be and previously it was Zero or no pending bill. It is settled position of law that Consumer Commission cannot go into the accounting process and we found no deficiency in service.

            However, talking a lenient view we direct the Complainant to make on exhaustive representation regarding his grievance to Ops with regard to change of ownership of beneficiary name, change of old meter and installation of new meter and also give some discount an  arrear. If the Complainant make any application within a period of 2 months from the date of passing of the order or one month from the date of receipt of the order then the Ops shall consider the grievance and settle the dispute in accordance with the Rules/Regulation & norms of Electricity Act within  45 days thereafter.With the aforesaid observation and direction that, the  C.C.Case No. 24/2023 & IA No. 11/2023 are accordingly disposed off. No order as to cost.

                 Issue extract of the order to the parties for compliance.   

           Pronounced in the open Commission, on this the 15th  day of November,2023.
