The undisputed facts of the complainant’s case are as follows:
The complainant is a consumer of electricity supplied by the opposite party. The opposite party has been collecting excess electricity charges from the complainant. Though the complainant complained about the excess billing the opposite party did not pay any attention towards the same for their own reasons. However he opined that the excess billing
may be due to leak of electricity in the premises. Accordingly at the instance of the complainant on electrician checked the wiring of the house and found that it is in perfect condition. Thus the complainant is before us seeking direction against the opposite party to pay a compensation of Rs. 10,00,000/- which includes the excess electricity charges levied by the opposite party.
2. On receipt of notice from this Forum the opposite party appeared and sought time for filing their version. But subsequently they opted to remain absent for reasons of their own. No oral evidence was
adduced by complainant. Exbt. A1 to A26 were marked. Heard the complainant who appeared in person.
3. The only point that comes up for consideration is whether the complainant is entitled to get a compensation of Rs. 10 lakhs from the opposite party.
4. According to the complainant the opposite party has been demanding excess electricity charges every month, though her consumption of electricity is very low. Exbts. A1 to A25 are the electricity bills issued by the opposite party to the complainant from 19-06-2010 to 22-05-2014. As per Exbts. A1 to A25 the status of the electricity meter is ‘working’. On receipt of Exbt. A9 bill dated 23-05-2013 to the tune of Rs. 15,302/- the complainant preferred Exbt. A26 complaint dated 01-06-2013 to the opposite party stating that she has not consumed the electricity as stated in Exbt. A9 bill.
5. It is to be noted that nothing is on record to show that the opposite party issued Exbts. A1 to A25 bills stating excess consumption of electricity by the complainant than the actual consumption. The complainant is to carry the ball in proving the allegations in the complaint. The remedy open to the complainant is to conduct a through check up of the electrical
wiring inside her house with the help of an expert electrician and also to test the correctness of the electricity meter.
6. In the absence of any evidence to the contrary we do not find any deficiency in service on the part of the opposite party. Accordingly the complaint deserves dismissal. Ordered accordingly.
