                        The petitioner has  filed the present dispute alleging deficiency in service on the part of the O.Ps.

                        The facts relevant for the present dispute as per complaint petition shortly are that  the petitioner is a domestic consumer under the O.Ps. having consumer No.M11695D. The petitioner paying the electrical dues regularly.

                        That suddenly the O.Ps without any reason enhanced the constant demand from 1K.W to 2K.W and demanded excess amount in the monthly electricity bill. Thereafter the petitioner approached the O.Ps. through registered letter regarding correction of inflated bill and reduce the contact demand. But the O.Ps. without paying any heed to it remained silent.

                        Accordingly finding no other way the petitioner has  filed the present dispute  with the prayer necessary direction may be issued for reduce the load from 2K.W to 1 K.W and to revise the inflated bill.

                        After notices the O.Ps. have appeared and filed their written version . The O.Ps. have taken the following defence:

That the petitioner is a domestic consumer bearing consumer No.M11695D (6122/2212/0294) with C.D 2K.W .

The petitioner is a regular consumer and paying electricity bill as per last ledger.

The billing of the consumer is done as per meter ( actual) basis.

Connected demand on the date of verification on dt.05.08.15 is found. Verification sheet duly accepted by the petitioner is found . 1.825 K.W is enclosed.

Ledger copy of  the petitioner is enclosed for reference. Hence, the case may be dismissed on merit.

                        In view of the above pleadings we have perused the record along with documents and ledger copy filed from the side of the O.Ps that the energy charges has been assessed on average basis for some months ,which is contrary to regulation-86 and 93(8) of OERC Code-2004 and the load enhanced has been done as proper verification of the premises of the petitioner by the O.Ps.

                        In the above observation from our side we dispose of the dispute as per the order given below.

                In the net result  the dispute is disposed of. The O.Ps. are directed to revise the provisional / load factor bill as mentioned  in the ledger copy as per section -97 of the OERC Code-2004 within three months after receipt of the order . No cost.
