Final Order / Judgement

MR. PRAVAT KUMAR PADHI, PRESIDENT:-

             Complainant has filed a C.C.Case No. 21/2023 U/s-35 of C.P.Act, 2019 seeking a direction not to disconnect the power supply and sent independent inspection team of TPCODL for fare physical verification of load factor and fine of Rs. 1,17,410/- and compensation of Rs. 1,00,000/- towards mental agony and Rs. 20,0000/- towards cost of litigation.

            This case relates to tampering of meter which involves U/S-126, 135 to 138 of Electricity Act, 2003 and the Ops rely upon the decision of Hon’ble Apex Court in case of U.P. Power Corporation vrs Anish Ahmed.

In view of the decision of Honbl’e Apex Court this Commission has no power to entertain any dispute with regard to the matter relating to the above section of Electricity Act, 2003.

                The Complainant submitted that he is a poor person and cannot go to different Forum to exhaust the remedy and to consider his case sympathetically.

            Taking a lenient view we disposed off the C.C.Case directing the Ops to settle the claim by deducting 40% as is being deducted normally by the Ops in such type of cases and settle the dispute by allowing to pay the amount in 15 monthly installments alongwith regular bill.

              With the aforesaid observation the C.C.Case No. 21/2023 along with I.A 8/2023 are accordingly disposed off. No order as to cost.

                 Issue extract of the order to the parties for compliance.   

           Pronounced in the open Commission, on this the 22th  day of November,2023.
