The case is posted today for further order. Today, the Authorised representative for the O.Ps files objection as well as w/v (show cause) as against Misc. case of Dhr. As per order in C.D.C No.148/2008, dt.30.05.12, it was given direction to O.Ps to waive out the disputed amount of Rs.16,113/- from the electric bill with a direction to Complainant to pay regular electric bill before the O.Ps to avoid further litigation. But the O.Ps preferred an Appeal before Hon’ble State C.D.R Commission, Cuttack bearing F.A No.894/2012 & Misc. Case No.1476/2012 as against the impugned order of District Forum, Balasore on 30.05.2012 in C.D.C No.148/2008. Subsequently, the preffering appeal is rejected & Misc. case is dismissed and F.A No.894 of 2012 also stands dismissed by the Hon’ble State Commission, Cuttack. Today the Complainant went represented. The Authorised representative for O.Ps stated before the Forum that as per order of District Forum in C.D.C No.148/2008, the O.Ps have already waived out the disputed amount from Consumer’s Account amounting to Rs.16,113/- in the billing month of August, 2014 & files abstract copy of the same before this Forum. Perused all the documents filed by the O.Ps today. In view of considering the above facts & circumstances, we are in conclusion that there is no need to proceed/ continue further this Misc. case in this Forum. Hence, the Misc. case filed by the Dhr is hereby dropped & disposed of accordingly.
