Complainant is absent .No steps taken on his behalf.counsel for Ops filed Hazira and present it is seen that since filing of  version complainant is pending absent and for which hearing cannot be trailer .A part from that it is seen that the case have been filed be the complainant alleging deficiency of service against Ops and the Ops have filed version stating that on 18.10.12 vigilance squared the premises of the complainant is as coming 6.am load than the sanctioned amount of 1.5 kw and hence notice u/s 126 of electricity act with provisional ansermet  sent of the complainant. Recently the Hon’ble S.C of India deciding civil Appeal No 35906 of 2011 between up power commission Advs Arij Ahamad decided that complainant again the assessment made in assembly officer u/s 126 on against office committed u/s B5 & 140 of electricity Act 2003 is not maintainable before consumer forum and hence as the complainant did not attend prosecute his case .the case is dismissed due to default the complainant always devoid of merit.
