                             Ajit Singh Versus DHBVN etc.

Present:                 Complainant in person.                                        

ORDER

                             Complaint presented today. It be checked and registered.         

2.                          By way of present complaint, the complainant has submitted that on 12.04.2013 he had applied for providing a domestic electricity supply with the Ops vide application No.42678 and had also completed all the formalities besides depositing of Rs.1010/- vide receipt No.171 but despite that the Ops have not provided the domestic electricity supply till today. Due to inaction on the part of Ops, he is facing a lot of hardship and the Ops are not only deficient in providing service to him but also indulged in unfair trade practice. Hence, this complaint.

3.                          Heard on the point of maintainability of the complaint.

4.                          As per the, complainant he had applied for providing a domestic electricity connection with the Ops in the year 2013, therefore, the present complaint is not maintainable before this Commission being barred by limitation. Further, the complainant has also failed to satisfy this Commission with regard to having sufficient cause for not filing the present compliant within the specific and prescribed period. The relevant Section with regard to limitation of a consumer complaint is as under:

69.  Limitation period.

(1) The District Forum, the State Commission or the National Commission shall not admit a complaint unless it is filed within two years from the date on which the cause of action has arisen.

(2) Notwithstanding anything contained in sub- section (1), a complaint may be entertained after the period specified in sub- section (1), if the complainant satisfies the District Commission, the State Commission or the National Commission, as the case may be, that he had sufficient cause for not filing the complaint within such period:

 

                             Keeping in view the above facts and circumstances of the present complaint, we are of the considered view that the present complaint is not maintainable before this Commission being barred by limitation as it has been filed after a long gap of 10 years. Accordingly, we dismiss the present complaint. Copy of this order be supplied to complainant free of costs. File be consigned to the record room.
