JUDGMENT

  1. The present complaint has been filed by the complainant before this commission for the following reliefs
  1. Op be directed to recall the notice dated 11.09.2017 .
  2. Op be restrained from disconnecting the connection on the basis of said notice.
  1. The Complainant has stated that he has the electricity LMV2 for Chakki and has been making payment of electricity bill. A notice dated 11.9.2017 demanded assessment amount Rs.264450/ alleging electricity theft on the basis of checking allegedly made on 2.9.2014. No checking was made and the complainant has never signed any checking report. In the year 2014 connection was disconnected in default of payment of the assessment amount.
  2.  Op submitted in WS that an amount of Rs.264475/ due against the complainant and op has right to realize the said amount from the complainant. On 2.9.2014 complainant was found on checking committing the electricity theft and the assessment amount Rs. 264450/ was raised and send to the complainant and on failure to make the payment of the bill demand notice 11.9.2017 was issued.. 
  3. Complainant has filed his affidavit and papers in support of his pleadings.  Op has also filed his affidavit and papers  in support of his pleadings
  4. We have perused the material available on record and heard the parties counsel.
  5. The first question of consideration before us is whether the complainant is entitled to any relief?
  6. Complainant has challenged the demand Rs.264450/ based on assessment made on checking when the complainant was found committing electricity theft. Complainant has simply denied allegation of electricity theft whereas op has rebutted the complainant’s allegations. The op is a government department and its officials are presume to have acted as per provisions of electricity laws and the complainant has not stated the shortcoming in making checking and no provision of law was brought to the notice which was violated by the officials of the op in making checking and raisig the assessment on the basis of said checking. There is no substance in the complaint and is liable to be dismissed.           
  7.   The question formulated above against the complainant.
  8.   We hereby dismissed the complaint.
  9. A copy of this judgment be provided to all the parties as per rule as mandated by Consumer Protection Act, 2019. The judgment be uploaded forthwith on the website of the commission for the perusal of the parties.
  10. File be consigned to record room along with a copy of this judgment.
