The case is posted today for hearing. Both the complainant & his Advocate are absent, no steps filed. Advocate for the O.Ps is present & files hazira.
On perusal of the case record, it is seen that the complainant remained absent since 22.03.2024. Advocate for the O.Ps has submitted that in the meantime, the O.Ps have already revised the electric bills and taking that advantage, the complainant remained absent in the hearing, for which the O.Ps are suffering a lot. Considering the submissions advanced from the side of the O.Ps, this Commission felt it proper to dispose of the case on hearing the case from the side of the O.Ps. Heard from the side of the O.Ps.
We have already heard the Advocate for the Ops. Perused the complainant petition and the documents. The complainant has stated in his complaint petition that he is a domestic consumer under the O.Ps. On 12.06.2023, the O.Ps threatened him to disconnect the power supply to his premises although he has paid the dues regularly. Suddenly, the current bill shows an arrear amount of Rs.1,09,957.13 paisa, for which he complained before the authority, but they did not revise the same.
On the other hand, in their written version, O.Ps have stated that a new meter was installed in the premises of the complainant on 08.12.2018 and during verification, it came to light that meter reading was 26083 as on 19.05.2023 and on that basis bill of the complainant has been revised and a sum of Rs.1,09,958.17 paisa has been added to the account of the complainant in the month of May, 2023. The O.Ps have filed documents to substantiate their case.
On perusal of the documents filed on behalf of the O.Ps, it is seen that the O.Ps have already revised the electric bills of the complainant from February, 2019 to April, 2023 on the basis of units as per meter i.e. FR of 26083 Kwh and an amount of Rs.1,09,958.17 paisa has been debited in the energy bill of the complainant. On the other hand, the complainant has not filed any document to show that the O.Ps have not revised the electric bills in his favour. From the above, it is presumed that the complainant intentionally avoided to take part in the hearing because the O.Ps have revised the electric bills in the meantime.
On the other hand, as it is seen from the case record that one Pradipta Kumar Das was the complainant and after his death, the present complainant Sri Abinash Das substituted as the complainant vide order dated 12.03.2024, who was directed to file consolidated amended complaint, but till date, the present complainant has not filed the consolidated amended complaint.
From the foregoing discussions, it is held that the complainant has no interest to prosecute his case. Hence, the complaint is liable to be dismissed.
Accordingly, the case of the complainant is dismissed on contest against the O.Ps without any cost. The interim order, if any, passed against the O.Ps is treated to be infructuous.
