Case Record is taken   up today for removal of defects and hearing on admission. The complainant is absent on call.

       On perusal of the complaint petition and documents relied by the complainant is  found that the complainant has sought for information from the opposite Party under RTI Act and due to non supply of the required information he got aggrieved and present his grievance before this Commission for a  direction to supply the required information.

       Law is well settled in RE Sanjaya Kumar Mishra Vrs. Public Information Officer decided on 08.01.2015 in Revision Petition No.3146/2012  where Hon’ble National CDR Commission hold that “The person seeking information under the provisions of RTI Act can’t be said to be a consumer viz-viz the Public Authority concern or CPIO/PIO  nominated by it and (ii)  the jurisdiction of the Consumer For a in the matters arising out of the provisions of the RTI Act is barred by necessary implications as also under the provisions of Sec.23 of the said a

Act. Consequently no complaint by a person arising deficiency of service rendered by the CPIO/PIO is maintainable before the Fora”.

       In view of the above said observations of the Hon’ble National Commission, the complaint petition is not admissible for adjudication before this District Commission.

       The complainant is at liberty to present his case before the proper Forum. Office to return the complaint petition along with documents filed therein to the complainant. Accordingly the case is disposed of.
