Final Order / Judgement

 

The grievance of the complainant is that he is a consumer of the Opposite Parties vide consumer No. 713101030148 and he was regularly paying the Electricity bills of the O.Ps. But surprisingly on 23.10.2014 he has received an exaggerated bill demanding a sum of Rs. 38,128/- bill of September, 2014 which is extremely high in compare to previous consumptions and such demand by the O.Ps is without any reason thus exaggeration has caused him financial loss, mental agony and physical harassment Hence he has approached this forum for the protection and relief as per his prayer.

2. The O.Ps in their counter submitted that the complainant has got the with actual meter reading which raised the bill to an amount Rs. 39,411 in the month of Oct-2014. He neither filed any complain nor appeared before the Southco office for revised bill. However the Ops assuring to revise the bill after installation of new meter as per OERC guideline, thereby no deficiency of service, damage or harassment in any way caused to the complainant at any time.

3. From the written version submitted by the O.Ps, it is crystal clear that they have charged excess which definitely caused harassment to the poor consumer and finally finding no other alternative he approached this forum by spending his valuable time and money for redressal of his grievances.

4. In the result, the complaint of the complainant is fit to be allowed in part and complainant is entitled to an appropriate order in terms of Section 14 of the C.P. Act. Hence, we proceed to pass the following order. Hence it is ORDERED :

                                                                        ORDER

The bill of September,2014 issued against the complainant be quashed. The opposite parties are directed issue proper bill after fixing a new and perfect meter at the cost of the Opposite Parties, after observing three months consumption, fix average monthly consumption from July-August, 2013 onwards, deduct the total payments made by the complainant from the total amounts and the complainant is to pay the said revised amount after its receipt on installment basis. The Forum also ordered the O.Ps to pay Rs. 2000/- to complainant as compensation for mental agony and Rs. 1000/- as cost of the case within 30 days from the date of the order.

The complainant petition allowed.

Copy of the order be communicated to the parties as per rules.
