Facts in brief:-

1. The complainant herein is a Senior Citizen aged more than 75 years old.

2. The complainant is possessing two quarters which are constructed more than 30 years back. The complainant had applied for the water connection. Though the pipe was fitted, there was no water in it but only seen the 'air'. Opposite party No.1 convinced the complainant that there is Air Pressure in the pipe and they are going to put up a machine on the pipe line.

3. Even after the above promise, the complainant did not get the water and the complainant had decided to cancel the water connection. There after the meter and connection were by the opposite party No.1 and at the time of disconnection opposite party No.1 informed the complainant that he will receive the refund amount if any. The complainant had applied for the water connection more than 22 years back. There after he is having no water connection under opposite party.

While so the opposite party No.2 and 3 initiated Revenue Recovery proceedings against the complainant by sending a demand notice for an amount of Rs.47,776/- dated, 30-07-2012 as per the direction of opposite party No.1. Thereafter the complainant approached the opposite party No.1 and they informed that they had committed a mistake and directed the complainant to file a petition for requesting the withdrawal of the notice. Thereafter the complainant made a request before the opposite party No.1 but it was of no avail. Hence this complaint.

5. The opposite party No.1, in their written version admitted that they had given a connection tot he complainant before 10 years. According to them the complainant is holding the residential quarters of Building No.1/250 to 1/269. Though there is a well in the premise it is not in a condition to use. The whole residents in the quarters are using the water provided by the Water Authority. The opposite party No.1 had not received any complaint from the complainant that he is not getting the water. If the meter is testing, one was find out that the complainant is using the water by using the above connection.

6. After receiving the water connection, the complainant had not paid any single amount towards opposite party No.1. So they issued a notice dated, 10-02-03. But the complainant was not ready to pay the amount. Thereafter on 30-12-2010, another notice was issued for an amount of Rs.38,425/- and the consumer connection was disconnected. Even after, the disconnection,t he complainant was not willing to pay
