Final Order / Judgement

ORDER BY HON’BLE PRESIDENT- MR. P.K. PADHI:

                                                                                    JUDGMENT

            Complainant has filed this consumer complaint U/s.35 of C.P. Act, 2019 seeking following reliefs;

            “Direct the opposite parties not to disconnect power supply from the premises of the complainant and pay compensation Rs.10,000/- towards mental agony and litigation for the wrongful act”.

            The brief fact of the case is that, the complainant is a domestic consumer before the opposite parties vide consumer account No.03541234. The complainant previously filed one C.C. No.30/2017 along with a misc case No.17/2017 before this commission. This Commission also directed the complainant for payment of Rs.4,000/- towards arrear dues and on that score the complainant has deposited the said amount before the opposite parties. But till date no bill has been corrected and no final assessment was issued to the complainant for payment of electric bill. Without correction of bill the opposite party No.1 issued disconnection notice and demanding Rs.20,805/- for arrear dues deposit within 15 days.

            Opposite parties filed written version stating as under;

            During analysis of the complainant ledger, a sum of Rs.19,843/- debited to the complainant account in the month 02/2015 due to bypass the meter. At this time the distribution franchise Enzen Global Solution executed the Lt Line maintenance, billing, collection. And also the average billing period from 01/15 to 07/15 is already revised and a sum of Rs.3,888.64 paisa credited in the complainant ledger in the month of 05/2016. So the opposite party demanding the arrears dues and serve DC notice.

            As it reveals the matter relates to accounts dispute which in our considered opinion needs no interference. However we dispose of the consumer complaint directing the opposite parties to give 30% discount as is being giving normally, provided complainant pays the entire due within 45 days from the date of receipt of the order. With the aforesaid observation and direction the consumer complaint is disposed of. No cost.
